Read carefully and completely. If you do not agree or understand all of these terms, do not commission me.

Upon sending payment, you are agreeing to the following terms and conditions:

  • By commissioning, it means you (the client) are hiring me (the artist, "Takesu") for my time and artistic labor to illustrate digital artwork based on your request as a paid service.

  • By default, I retain all copyrights to any images you receive from me pertaining to your commission, including any finished or unfinished works in progress (WIPs), designs, drafts, sketches, etc. Intellectual Property (IP) rights remain reserved to their owners.

  • Communication must remain professional and focused on your commission.

  • I reserve the right to decline any request or cancel and refund a commission for any reason.

  • A breach of the Terms will result in cancellation your current order(s) and a ban from doing further business with me. Any misuse of my artwork will result with legal action.

  • You assume all risks on how your commission is used and shared. I am not liable for any harassment, personal damages, loss or theft of your intellectual property or character design rights.

  • These rules may change/update without notice. Save a copy of this TOS with timestamp at time of ordering for your reference.

----------
TERMS OF USE & RIGHTS:

  • You may share and upload your commission of any version to your personal websites and social medias with credit.

  • You may use, crop, edit, print and self-finish your commission for your own personal use.

  • Do not "finish" your commission through another artist or by AI filter/processing.

  • Do not trace or claim the artwork as your own. Please properly credit me wherever possible.

  • Do not use any part of your commission that is considered unpaid, declined or canceled work.

  • Do not use your commission for your promotional, commercial or monetary gain; eg. branding, trademarking, merchandising, paywall services like Patreon or Gumroad, etc. unless you've been given the commercial licensing to.

  • You may give/share permission to use your commission to another party under these same terms and conditions; eg. if their IP is involved in your commission or character rights was given to another user.

  • In the event you are selling the rights of your character(s) involved, you may not resell your commission/adopted design for more than what you bought it for.

----------
PROCESS & PAYMENTS
Details of your commission must be discussed, provided with clear, up-to-date visual references, a concise description and any required information at time of ordering in order to be accepted and given a price quote.
- All payments must made through PayPal invoices of the amount(s) agreed upon with a valid email address. Do not send payment before I have accepted your commission.- Payments must be upfront. No work will start without payment first; and I may not start immediately. Full payment is required to finish your commission and receive full resolution, unwatermarked files.- You may request to change the details of your commission any time before I begin working on your commission but may be subject to a surcharge or refund if the cost greatly differs from your original quote.EDITS & APPROVALS:
Check your messages. You are responsible for checking your messages and responding within a timely manner. You will receive works in progress updates when your feedback/approval is needed to progress.
- Two main WIP stages are the sketch of the layout/pose and another after flat colors are added.- Freely correct me on any mistakes made on my part that were clearly noted design elements and relevant information was provided prior.- Minor changes/edits can be requested at any time prior to the completion of the commission for free up to 3 times. Further edits will incur a fee.- One large revision (eg. changing pose/layout or props) may be requested free of charge only during the sketch phase. Further revisions will incur an overtime rate fee.- Any large revisions requested after the sketch have been approved will incur an overtime rate fee.- If no response is given within 60 hours of WIP delivery the commission will be continued as is.Finalizing the Commission:
When all payments are made in full and the artwork is finished, you will receive your commission in its full resolution along with lower resolution and watermarked versions for web upload. Once the finished artwork has been approved and no further changes needed, the commission will be marked as completed and delivered.
- Delivery is made through the current contact method being used, either by direct upload or via Sta.sh for up to 30 days. You are responsible for downloading your own copies for yourself.- Any edit or revision requested after the final art is delivered will incur an overtime rate fee.----------
Turnaround times varies.
Most commissions are completed within 2 months from time of initial payment. However, turnaround times are not always guaranteed as real life hardships can disrupt workflow and can vary depending where your place in the queue is and how complicated each person's commissions are in the queue.
- Any due date/deadline expectations must be discussed and agreed on by both parties prior to having the commission accepted.- Any deadline requests that hastens the commission progress after acceptance may be subjected to a rush fee. Extensions are allowed but may not be shortened once in progress.- I will not be liable if you failed to communicate, delaying your commission and losing priority in my work queue.----------
CANCELLATIONS & REFUNDS:
If you decide to cancel your commission at anytime, the amount eligible for refund will be based on how much time has already been put into the commission.
- A full refund may only be made if I canceled the commission myself or I was at fault for failing to meet the agreed deadline. If you cancel before work has started, any irreversible transaction fees made will be deducted from your refund.- A full refund is not eligible if deadlines were missed when you failed to communicate or you prolonged the delay of the completion of your commission by requesting drastic or too many revisions.- Partial refunds will be the total paid deducted by $25 per hour worked on your commission and any transaction fees lost in the initial payment. Payments for revisions made are not refundable.- No refund will be issued if your commission is completed, in its final stage or the $25 per hour worked amount exceeds your total paid.- Privacy fee is not refundable once the commission is completed, even if you allow me to publicly post it.- I am not obligated to cover any transaction fees lost during the refund process. If you force a full refund or issue a chargeback, you will lose all the rights and usage permissions to any images you receive from me and banned from doing further business with me.

Frequently Asked Questions

Here are my Frequently Asked Questions about commissions! Apologies if I don't answer your questions when they're listed here. All other questions or concerns feel free to contact me any time BEFORE commission openings in case I don't go through them until after they close. These answers are general and not strict. Exceptions are rare and may change as circumstances changes. These are NOT the same as "Terms of Service", rules of which you must abide by upon commissioning me.----------
OPENINGS:
- When/where do you open for commissions?
Commissions are taken roughly around the end of each monthly queue through a Google Form. An announcement for the exact time for the opening and will be made at least 24 hours prior at this dedicated Twitter account. There may be times where I skip openings so check for exceptions if any. The form will be posted on Furaffinity journal and the updates Twitter.
- Are you currently open?/ How do I request a commission?
If the commissions request form is open, yes. If not, wait for it to open. Once you successfully summited a form, it may up to 48 hours for a reply if you get accepted or opted-in for a response. Forms may close suddenly so don't take too long filling one out. Forms submitted after they close will not be received and may reopen later if any pending slots drop out or queue was finished early.
- Are these first come first served?
Slots are not fcfs and not everyone may be accepted for scheduling and planning purposes, but sending a request as soon the form open is recommended as it will close early with enough entries.
- Can I reserve a slot before opening or submit a late submission?
For fairness, I only accept those who submitted a form during openings. I cannot hold you a slot if you don't have your info ready. Please plan accordingly and try again next time.
- Can I submit more than one request at a time?
You may but if only allowing me to pick one please keep the number of requests down to a few as I don't want to spend too much time deciding.
- How does waitlist work, how do I get on it?
The waitlist is for those whos requests are not accepted immediately due to limited slots. They will be reconsidered one more time for the next opening. Waitlisters will not be charged and pre-updated pricing will be honored for only that next opening. You can ONLY opt-in to be put on the waitlist while successfully submitting a form. If you decline to take the next open slot when offered, you can not be put back on again until you fill out another form.
- My request wasn't accepted, can I apply again?
Absolutely! It is very encouraged to try again when you get the chance. Please do not take it personally or get discouraged if you didn't get a slot. There are many good requests that don't get in their first try but do another time.
----------
SUBMISSIONS:
- Can I change the details of my form after submitting?
Yes. Whether you were waitlisted or already paid, you can change your idea at anytime before your commission is started, preferably closer to your turn in queue. However, not every change may be accepted if it drastically differs from the original price quote.
- I need a copy of my form, do you have it?
If your form is submitted on time, you should have automatically gotten a copy of your form as confirmation in the first e-mail you've entered. If you lost it or can't find it, I can send you a .pdf copy. If you did not submit your form on time, I will not have a record of it to make a copy of.
- What image counts as complex?
If it's more intricate than a basic image and may require more time to complete then it will be considered complex. Deciding factors can be the character's design, outfits, extra appendages, scales/markings, muscular structure, props/accessories, composition, etc. I'll decide if something is considered complex or not and charge accordingly.
- What's the difference btwn refined sketch and rendered?
Generally, refined sketches are lined and shaded quickly whereas rendered have them done more cleanly and detailed. Rendered images will also have more technical and anatomical corrections than refined sketches. Complexity fee can still apply to either type.
- Do you have other types of commission than what's offered?
Ask for a quote at anytime. But know just because I gave a quote doesn't mean I'll accept it next opening and prices may change since.
- Can you draw NSFW? Can we send references that are NSFW?
No, I don't draw NSFW. It can be in artistic nudity but nothing sexually explicit. Sending NSFW references is OK. I don't mind as long it's not excessive and relevant to the details of your commission.
----------
OTHER:
- When is payment due by?
When accepted, preferably soon due to limited number of slots and if you want to placed higher in the queue. No work will begin without payment first. Late or non-payment will result in your slot being skipped or cancelled and you may be barred from future commission openings. Do not send any unsolicited payments directly without prior approval.
- Do you offer installment plans?
Installment plans can be discussed for amounts over 300.
- How long are your turnaround times?
Depends on the image and your place in the queue, it could take from 2 days to 2 months. Although I mostly aim to complete them within the same month and order taken, monthly commissions are not guaranteed to be completed within that same month. Any due date expectations must be discussed prior to having your commission accepted.
- Do you have other forms of contact?
FA notes, e-mail, twitter and telegram are my only forms of contact. Long form messaging is preferred as details can be easily lost in instant messages. If I have you on IMs, please only use it for your commission and not for casual chatting. Also, don't expect a reply right away. I don't always get notifications instantly for DMs or emails that accidentally get filtered.
- Are there any updates to my commission?/Where can I find my place in the queue?
You may find the current stage of your image on my Trello under "Current Queue." Any updates that needs your approval will be messaged to you. If your slot doesn't have any image attached that either means the sketch is not ready or I haven't started on yours yet.
- When/where do you post finished commissions?
Usually as soon as the final art is approved to my gallery sites. Social Media posts may be staggered. You will be tagged on the main twitter post if your handle is easily found. If you don't want be tagged or want to be tagged in a reply instead, please let me know ahead of time! If you get too many notifications you can always mute the tweet. You may post your commission whenever as you please, just don't forget to credit and tag me so I can retweet it!
- Can I upload my high-res, unwatermarked copy?
Although not recommended, you may upload any version of your commission if you wish. It's preferred you upload your lower quality, watermarked copy to deter art theft by bad actors and AI Technology.
